Wake teen appeals sentence in freezer death case
A Wake County teen who admitted to killing his father more than three years ago at the urging of his mother wants his sentence reduced.
Posted — UpdatedDavid Ruben Green III pleaded guilty last year to second-degree murder and conspiracy to commit murder in the death of David Ruben Green Jr.
He was prosecuted as an adult, even though he was 13 at the time of the murder, and was sentenced to a maximum of 26 years in prison.
Investigators say the murder happened in January 2009 after David Green Jr. threatened to kill Wendy Green, his longtime girlfriend, during an argument involving their 15-year-old daughter, Alexis Green.
Wendy Green then convinced her son to kill his father, and the family then used a dog leash to drag his body to the basement and put him in a freezer in their house on Ray Road.
Other family members reported David Green Jr. missing, and an investigator found his body in the freezer in late 2010.
David Green III claims in his appeal that the judge who sentenced him should have given more weight to his age, the abuse his parents inflicted on him and the fact that his mother pressured him to kill his father. Such mitigating factors should have resulted in a shorter sentence, the appeal states.
