Prosecution Rests in Boggess Murder Trial

The prosecution wrapped up its case Thursday in a Durham murder trial dating back to the 1990s.

DURHAM, N.C. — The prosecution wrapped up its case Thursday in a Durham murder trial dating back to the 1990s.

Todd Boggess is charged with the slaying of Wilmington honor student Danny Pence. Pence, 16, was found beaten to death in a wooded area of northern Durham County in 1995.

Boggess was later convicted and sentenced to die, but the conviction was overturned on a technicality.

Boggess' lawyers are expected to present their case later Thursday afternoon. They are expected to call only one witness to the stand -- a doctor testifying about Boggess' mental state.

Prosecutors are not seeking the death penalty.
