Police: Driver In Fatal Bus-Stop Wreck Was Drunk, Speeding

Raleigh police said they plan to file charges of second-degree murder and driving-while-impaired against Jason Daniel Oliver, 28, of Durham.

One man was killed and a second critically injured in the accident at Buck Jones Road and Bashford Road around 5:30 p.m.

Oliver also faces charges of felony aggravated assault, driving with a revoked license, consuming alcohol while driving and having an open container of alcohol in his car.

Oliver was sentenced to 91 days in jail for a previous DWI in October 2002 in Vance County. His license was revoked then, and he was also fined $300 and given 18-months' probation, according to court records.

He was cited for driving on a revoked license in April 1999 and operating a motor vehicle without a license in April 1995.

Court records show that Oliver had an extensive criminal record, dating back to April 1995. Authorities filed 23 charges against him, mostly in Durham and Vance and Craven counties.

Oliver has also faced charges for assault, counterfeiting and drug offenses.

In the Friday accident, witnesses told police that Oliver was driving in a reckless manner before his lost control of his Chevrolet car. He was driving 65 mph when he hit two men standing on the grass while waiting for the bus

The men were thrown about 70 feet and landed in the road near a convenience store. Oliver did not slow down before hitting them, according to the accident report.

Jesus Gonzales Garcia, 33, died at the scene.

Walter Rodriguez Garcia, 23, was transported to WakeMed and was upgraded to good condition Saturday afternoon.

Oliver was also in good condition at WakeMed Saturday afternoon. When he is released, he'll be transported to the Wake County Jail, police said.
