Posted Updated

RALEIGH — A federal appeals court will not rehear North Carolina's appeal over theLake Gaston pipeline, but state leaders aren't about to give up.

In May, an appeals court ruled that Virginia Power doesn't need NorthCarolina's authorization to suck 60 million gallons of water per day fromLake Gaston. Virginia Beach, which must buy its water from Norfolk, hasbeen trying for nearly 15 years to tap the lake.

Right now state officials aren't saying if they will take their case tothe Supreme Court.
