Posted Updated

DURHAM, N.C. — The North Carolina Court of Appeals upheld a ruling Tuesday that ordered a refund of Durham County impact fees.

A group of homebuilders sued the county. A judge ruled the one-time fee ordinance was invalid.

The county was ordered to repay more than $7 million.

The county's attorney plans to take the appeal to the state Supreme Court.
