Custody Hearing Postponed After Ann Miller Kontz Fires Attorney

NEW HANOVER COUNTY, N.C. — A hearing regarding the custody of the daughter of Ann Miller Kontz was postponed Wednesday in New Hanover County.

Kontz is serving a 25-year sentence for the arsenic poisoning death of her husband, Eric Miller, who died in December 2000.

Currently, the couple's 6-year-old daughter, Clare, is in the custody of Kontz's sister. Eric Miller's parents and sister, however, are now interested in gaining custody of the child.

The hearing was postponed after Kontz wrote a letter to her attorney, Ralph Pennington, firing him in the custody matter. Pennington refused to say why Kontz fired him, only that he was withdrawing from the case.

A new hearing has been set for April 6. At that time, a judge will decide whether the Miller family has legal standing to ask for custody of the child.
