Charges against Leroy Samuels were dropped late last week after a DNA test eliminated him as a suspect in the February rape and kidnapping of a woman in Durham's Trinity Park neighborhood.
Samuels had been in jail since April under a $150,000 bond.
Durham police now have to find the person who committed the crimes. They say the DNA evidence points to Jeffery Lamont McNeill, 30, who is still on the run.
McNeill is described as a 6-foot-2-inch black male, weighing 170 pounds. Police say he has a slim build, acne scars on his face, and he may have a short beard, mustache, or goatee.
Police say McNeill frequents the Ninth Street area, Lincoln Community Health Center, McDougald Terrace, and area homeless shelters.
