Little Austin Newberry has been upgraded from critical to stable condition at Wake Medical Center after being bitten by a family dog.

A game of catch was being played Saturday with the dog, a Labrador and German shepherd mix, when 22-month-old Austin wandered too close to the stick being used as a toy. The dog reportedly turned and snapped at Austin, catching the child's face.

The dog is in the custody of Wake County animal control officers for 10 days to ensure that it does not have rabies. It is unlikely the animal will be destroyed.

The dog belongs to Austin Newberry's uncle, and was kept in a pen on Tryon Road in Raleigh, where the incident occurred
