Peterson Lawyer Prepares Brief For Court Of Appeals

RALEIGH, N.C. — Mike Peterson's lawyer plans to hand in his brief to the Court of Appeals exactly two years to the day after the Durham novelist was convicted of murder.

A jury found Peterson guilty of killing his wife Kathleen in October 2003.

Attorney Tom Maher believes jurors never should have heard evidence regarding Peterson's sexuality or the death of family friend Elizabeth Ratliff. He also said police searches of the couple's mansion were unconstitutional.

It could take months before the appeals court makes a decision. Peterson is serving a life sentence at Nash Correctional.
