Republican candidate Bill Fletcher was seeking that certification in the race be delayed and that the race be placed on the ballot during the special election in Carteret County.
Democrat June Atkinson leads Fletcher 1,655,719 to 1,647,184, but Fletcher believes the gap in Carteret County, where some votes were lost, could change the outcome.
"It's interesting if there are 24,000 votes in Carteret County, that certainly puts the margin of our race in play in Carteret County," Fletcher said.
The hearing was delayed Monday morning after Judge Narley Cashwell refused to hear the case, saying he had a conflict.
