Attorneys Want To Exclude Some Evidence In Deputy's Murder Trial

Matthew Grant is charged with first-degree murder. Investigators say he shot and killed Mark Tucker in a field on Holly Springs Road in February.

Tucker's family has vowed to see the trial through to the end.

"I can't tell you how difficult it is to sit right there, knowing that the guy who killed my brother is standing within three or four feet of me," said Dan Tucker, Mark's brother.

"This is the second time that I have seen him. He never made any facial expression, no signs of remorse, nothing," said Buddy Tucker, Mark's brother.

Grant's attorneys argued two things Monday. They want a statement Grant made to investigators and evidence from a search of his home excluded from the trial.

Investigators say Grant, who was on probation at the time of the shooting, knew Tucker was an officer. They say Grant admitted to killing Tucker, saying he had a gun, which may have been a violation of his parole.

Jury selection for the trial starts on Oct. 11.
