The State Bureau of Investigation arrested Officer Jared Reyes, 29, around 6 a.m. Friday. Investigators say the charge stems from Reyes shooting a suspect, 31-year-old James Earl Davis.
Reyes reportedly saw Davis driving a stolen Saturn on Sept. 13 on Alston Street in Raleigh. Officials said when Reyes confronted Davis, both men struggled. The report states Davis held a screwdriver and resisted arrest. He later jumped back into his car and reportedly started to drive away.
Reyes fired six shots at the vehicle, one of them hitting Davis in the back. Davis was critically injured, but survived.
Raleigh police policy prohibits officers firing at moving vehicles unless deadly physical force is being used against the officer other than the moving vehicle. The misdemeanor charge is punishable by up to 120 days in jail.
Davis is currently in jail on charges of possession of stolen property and possession of a stolen vehicle. His case is pending.
