JOHNSTON COUNTY, N.C. — A death penalty appeal hearing continues Tuesday for a man accused of murdering a Johnston County couple.

George Goode's attorneys are battling with prosecutors over the validity of evidence used during the original trial.

Goode is one of three suspects convicted in the 1992 stabbing deaths of Leon and Margaret Batten.

At a death penalty appeals hearing Monday, his attorneys put a psychiatrist on the stand, who questioned the credibility of the state's key eyewitness -- a man with a history of mental illness.

Both defense lawyers and prosecutors are also battling over the validity of blood evidence.
