Former Durham Restaurant Owner Sues State DOT

DURHAM, N.C. — The former owner of a popular Durham restaurant that was forced to shut down for road work is fighting back.

Aubrey Foster, who ran Pan Pan Diner, is suing the state Department of Transportation.

The restaurant shut down in February when the DOT started building an exit ramp as part of the Interstate 85 expansion.

Foster said he was not adequately compensated and is suing for $1.5 million.
