Charge Filed After Man Run Over, Killed During Brawl

FAYETTEVILLE, N.C. — A 39-year-old man has been charged in connection with the death of a man who was run over by a car during a brawl outside a nightclub.

Kenneth Neil Gerber, 39, of Whispering Pines Drive in Fayetteville, was charged with involuntary manslaughter. He previously was charged with driving while impaired in connection with the Sept. 16 incident.

The incident began in the parking lot of The Place, at 5328 Bragg Blvd., shortly after 4 a.m. that Saturday when a number of people began fighting, police said. In the middle of the altercation, a vehicle drove through the crowd, ran over a man who was fighting and then backed up over him again, police said.

Jason Shirey, 25, of Carnegie Drive in Fayetteville, was pronounced dead at the scene.

Police filed the involuntary manslaughter charge because they were unable to prove Gerber hit the man intentionally, said Jamie Smith, spokeswoman for the Fayetteville Police Department.
