Detective David Powell was shot outside a sports bar in July where he was working off-duty security. Custodio Ramirez is charged with attempted murder and two counts of assault.
In closing arguments, the defense told the jury there was no pre-meditation involved in the crime.
"There's an assault. There's a deadly weapon. There's serious injury. Beyond that, there is a whole lot of questions we can't answer," said defense attorney David Brannon.
"It defies logic and explanation, but what I ask you is that you don't excuse evil doings because you don't understand why," said district attorney Colon Willoughby.
Late Wednesday afternoon, the jury told the judge they were deadlocked by a vote of 10-2. They plan to resume deliberations 9:30 a.m. Thursday.
