Sources: Sexual advance could have triggered stabbing

A 29-year-old man was charged early Wednesday in connection with a stabbing that happened Tuesday night near a bus stop on West Morgan Street.

RALEIGH, N.C. — Police in Raleigh charged 29-year-old Kevin Marshall Peacock with murder Wednesday in the death of a homeless man.

Multiple sources told WRAL News that Norman Lee Smith Jr. made a sexual advance on Peacock which could have prompted the attack.

Smith, 52, was stabbed shortly before 9 p.m. Tuesday near a bus stop on West Morgan Street, police spokesman Jim Sughrue said.
Authorities believe Smith walked to a nearby bar for help after being stabbed. He was taken to WakeMed, where he died.

Court records show Smith was a registered sex offender who was convicted of rape in 1996 and spent 8 years in prison.

Mike Phillips, owner of the Men at Work car wash in Raleigh, said he knew about Smith's criminal record, but allowed him to work anyway.

"He took pride in what he did," Phillips said. "We are going to miss him very much. This is a sad moment for us at Men at Work."

Smith lived in a local homeless shelter. People who knew him best said he was a good person.

"I just spoke to him the day before yesterday in the hallway up at the shelter," said Brian Smith. "It's sad because he was a good dude."

From the Wake County jail, Peacock, of 5808 W. 7th Ave., Stillwater, Okla., said he acted in fear and did not mean to kill Smith.
"I didn't know he was going to die. It was an accident. I was scared to death. I just wanted to get him off of me," Peacock said.
"I never meant for that to happen. I just wanted to get him away from me. I'm not a killer, that's not who I am."
