Hasentree members file suit over club's sale

Members of a an upscale golf community in Wake Forest filed suit Thursday against the developers who bought and sold their golf course, arguing they were not given the right to bid on it.

WAKE FOREST, N.C. — Members of a an upscale golf community in Wake Forest filed suit Thursday against the developers who bought and sold their golf course, arguing they were not given the right to bid on it.

Toll Brothers acquired the Hasentree Golf Club, a course designed by Tom Fazio, a 13,000-square-foot community center and all unsold home sites in the 805-acre community in February.

In the class-action lawsuit filed Thursday, Hasentree members argue that they should have had the right to buy the property when SunTrust Bank foreclosed on the development last year from developer Creedmoor Partners.

The plaintiffs argue that membership in the club included a provision that, should the club decide to sell facilities, members would have an option to purchase them. Members never got notice of the sale required by that agreement, the suit says.
