Autopsy: Slain burglar shot twice

A Fayetteville homeowner shot an intruder twice last month, killing him, according to an autopsy report.

FAYETTEVILLE, N.C. — A Fayetteville homeowner shot an intruder twice last month, killing him, according to an autopsy report.

Jerry Riley, 54, of 593 Tokay Drive, said a stranger confronted him as he entered his home on Jan. 17. Riley said he pulled a handgun on the intruder, and the two men then struggled over the gun.

The gun went off, and the intruder took the pistol and ran out of the house, police said.

Officers investigating the burglary found Joshua Caleb Pratt, 27, of 662 Glenola Drive, in the street with a gunshot would to the abdomen. He was taken to Cape Fear Valley Medical Center, where he died.

Pratt died of the stomach wound, and he also had a gunshot wound in his left shoulder, according to an autopsy report released Wednesday. He also was intoxicated at the time of his death, the report said.

Fayetteville police said Riley was justified in the shooting and wouldn't face criminal charges.
