DURHAM, N.C. — One of the two men who engaged in a shootout Friday in a Durham strip mall parking lot faces his first court appearance Monday.

Jacinto Barr, 33, who was wounded in the encounter, is slated for a first court appearance Monday afternoon, after having spent part of the weekend in the hospital. Barr is charged with assault with a deadly weapon, possession of a firearm by a felon, possession of drug paraphernalia and possession with intent to manufacture, sell or distribute heroin, according to the Durham County Sheriff's Department.

Law enforcement officers tracked Freddy Cheek, also 33, to a laundromat after the shooting and took him into custody. But Durham authorities said Monday that Cheek was not in custody and a court appearance had not been set for him.

Witnesses said the two men squared off across the parking lot and fired at least 19 shots at each other, blowing out windows of four businesses and damaging parked cars.
